Lifestyle Perks Terms & Conditions

Introduction: The following terms and conditions constitute the membership agreement between you (the person whose name appears on the welcome letter) and Lifestyle Perks (“we or us”), which is owned and operated by The Loyalty Marketing Group Limited, a company registered in England and Wales with company number 13697272. You are urged to read these terms and conditions carefully.   1. Membership Benefits: As a Lifestyle Perks member, as explained in the welcome pack, email and/or online account, you are entitled to discounts and/or rewards, freebies and benefits on products and services offered by participating providers (“benefits”).
  2. Telephone Sales: Your Lifestyle Perks membership may begin with an initial preview, trial or introductory membership with either a zero cost, reduced cost, trial fee, set up fee or postage fee, as outlined in the welcome pack. Your full, paid-for membership will commence after the preview membership has ended. Any preview/trial/introductory/reduced rate, trial fee, set up fee or postage fee charged is non-refundable for this preview membership. You may cancel your membership at any time within this trial period. If you do not notify us that you do not wish to continue as a club member of Lifestyle Perks within the 14-day preview period by calling our customer service team on 0330 460 9561, your membership will become a full, paid-for membership when we charge the annual subscription fee at the agreed annual price outlined in your welcome pack. If we are unable to charge your specified payment method, you agree to provide an alternative billing source. You will become a full, paid-for member for the duration of the paid-for period when payment has cleared.
  3. Membership Renewal: The payment of your membership fee is charged automatically, as authorised by you when you agreed to your membership and/or preview/trial/introductory membership. We reserve the right to increase or decrease the membership fee for each renewal term effective upon renewal of your Lifestyle Perks membership. We may send you communication prior to your renewal date, reminding you of the automated renewal and renewal membership cost. Unless you notify us that you wish to cancel your Lifestyle Perks membership before your membership renewal date, the renewal payment will be automatically charged using your original payment method. If we are unable to charge you using your specified payment method, you agree to provide an alternative means of payment.
  4. Collecting Payments: If you have not provided an alternative payment method when there is an issue with collecting payment using the details securely passed to us following your agreement to join, we may try again a number of times for a period of twelve (12) months from the due date. The date we successfully charge your card will become your new renewal date.
    We may also securely share your details with third-party companies to aid us in retrieving up-to-date billing information and/or reattempt to bill you. If you do not keep up to date with your membership payments, we reserve the right to withdraw or restrict your membership until your account is brought up to date. If you fail to pay your Lifestyle Perks membership fee, either with the payment method given to us when joining, or using any alternative means within thirty (30) days of the fee being due, then we shall reserve the right to terminate your Lifestyle Perks membership. Termination means you will no longer have the right to redeem any rewards and/or the promotional offer.
  5. Unlocking of Rewards: When your full, paid-for Lifestyle Perks membership commences, you will become entitled to certain "unlockable" membership benefits. For full details of when these membership benefits unlock, please see the specific redemption terms on the Lifestyle Perks website. In order to claim and use these “unlockable” membership Benefits, you must ensure that your full, paid-for member membership is active, and that no outstanding payments are due.
  6. Exclusive Member Offers: As a Lifestyle Perks member, we will offer you ongoing and additional benefits as part of your annual membership. We may on occasion introduce you to exclusive member offers from ourselves or our partners where there is a charge for participation. We will send you a letter, to the address registered with us, to introduce each exclusive member offer prior to any fee being taken. Exclusive member offers will vary in cost, and the cost and billing frequency will be outlined in the letter. Unless you notify us that you do not want to continue with the introduced offer, a payment will be automatically taken from the payment method on file as explained in the introduction letter. If you prefer not to receive any exclusive member offer introductions, please contact our customer service team on 0330 460 9561.
  7. Disclaimer of Liability: You agree that we are not responsible or liable for any of the benefit providers. If you have any claims relating to any of these benefits, you will only claim directly against the providers of the benefit. Any such claim will be subject to and governed by the provider’s terms and conditions which you should read carefully. WE MAKE NO WARRANTIES EXPRESSED OR IMPLIED, INCLUDING THE WARRANTY OF SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO ANY OF THE MEMBERSHIP BENEFITS OR RELATED INFORMATION PROVIDED TO YOU. LIFESTYLE PERKS’ LIABILITY SHALL NOT EXCEED YOUR CURRENT MEMBERSHIP FEE AND UNDER NO CIRCUMSTANCES SHALL LIFESTYLE PERKS BE LIABLE TO YOU FOR INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES. We reserve the right to remove, add, change or substitute benefits and participating providers without notice to you. We assume no responsibility for the payment of, or contribution to, any sales tax, which taxing authorities may impose. Such taxes shall remain your sole responsibility or that of the provider of the benefits, as the case may be. Postal charges may be applied to cover costs of shipping but we make or give no warranties or representations, express or implied that you will receive this item. It is your responsibility to contact us before your trial is due to end if you have not received it. THIS DISCLAIMER DOES NOT AFFECT YOUR STATUTORY RIGHTS.
  8. Entire Agreement: This agreement contains all the terms of a Lifestyle Perks membership. Any other warranties, representations, terms, conditions, inducements, promises or agreements concerning your Lifestyle Perks membership, unless expressly included in this agreement, shall not form part of the agreement or have any force or effect. If any of the terms of this agreement shall become invalid or unenforceable, the remaining terms shall not be affected.
  9. Governing Law: This agreement shall be governed by and construed in accordance with English law, and both you and we accept the exclusive jurisdiction of the English courts.
  10. Use of Your Personal Information and Data Protection: Your personal details will be held and used by us for membership administration. We will only disclose your details to companies and individuals involved with the processing of this membership and/or its exclusive offers. We shall always require those processing your information to keep it confidential and not to disclose it to any unauthorised parties. Further details can be found within our Privacy Policy.
    In the interest of keeping you informed and up to date about our products and services, we may occasionally forward information to you regarding specific products and promotions that are related to your membership. If you would prefer not to receive information of this kind, please write to us or call our customer service team on 0330 460 9561.
  11. Cancellation of Preview Membership or Membership Renewal: To cancel your preview membership or if you do not wish to renew your membership, please call our customer service team on 0330 460 9561. These rights are in addition to your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
    If you email or write to us, we may need to contact you on the telephone so we can verify and process the cancellation request. This may delay your cancellation request. Cancellation will only take place once verification has occurred. If you are charged during this period, you may be eligible for a refund at our discretion.
    If you terminate your account with immediate effect, you are no longer an active member and will lose access to all benefits and rewards. If you have requested to cancel at the end of the paid-for period, you will continue to have access to the benefits and rewards redeemable, excluding “unlockable” rewards.
  12. Refund Policy: All fees are non-refundable. A customer is free to cancel during their trial or before their renewal date with no additional costs incurred.
    You are not entitled to a refund on any postage and packaging charges or the fee for the month or year in which a membership was cancelled, or any prior payments made in respect of your membership.
    Please note that no refund will be given after the payment is taken if contact by telephone cannot be proven to have occurred at least seventy-two (72) hours before the payment renewal date. Further, if any of the member rewards have been used, the product will have been deemed to be used by you and so in this circumstance, no refund will be given.
  13. Reservation of Rights: We reserve the right to remove, add, change and substitute benefits and benefit providers without prior notice. We further reserve the right to change the terms and conditions of this agreement and any Lifestyle Perks membership policies at any time without prior notice.
